Tracking the Hiring Trends that Matter for Lawyers

The pace of change in the legal industry has accelerated significantly over the past several years, driven by shifting client demands, evolving practice areas, and strategic competition among top firms for talent. For lawyers focused on serving clients and developing their practices, it can be difficult to maintain a clear view of how the broader hiring landscape is evolving. Yet those shifts often determine where opportunities emerge, which practice areas are growing, and how firms are structuring their teams.

“The legal hiring market moves much more strategically than it did even a decade ago,” notes Michelle Foster, Managing Partner at The Foster Group. “Firms are making highly targeted investments in talent, and attorneys who understand those dynamics are far better positioned to make thoughtful, career-enhancing moves.”

The Foster Group is a top-tier, full-service legal recruiting firm that plays a key role in helping attorneys interpret trends like those playing out in today’s legal market. By closely monitoring hiring patterns, partner movement, and practice expansion across the market, the firm helps partners, groups, counsel, and associates understand where demand is developing and where they are likely to find the strongest platforms for long-term growth. Top law firms and corporation also rely on The Foster Group for the insights and connections needed to find top talent that can drive strategic growth.

“One of the most common missteps we see lawyers make is assuming the market works the same way it did when they last considered a move,” explains Drew Foster, Managing Director at The Foster Group. “Yesterday’s assumptions rarely reflect today’s hiring priorities. The lawyers who approach the market strategically tend to have the most successful outcomes.”

For attorneys considering their next step, understanding these dynamics can make the difference between a routine lateral move and a transformative career opportunity. But as noted above, most attorneys lack the resources needed to keep up with trends and develop the insights needed to engage with the market effectively.

By partnering with The Foster Group, attorneys gain not only insights into the current market but also proven strategies for leveraging those insights for meaningful career growth. Michelle, who has over 25 years of experience in the field, Drew, who has an 11-year tenure, and Elaine Oh, who has worked with Michelle for nine years, have the expertise needed to navigate the market and maintain relationships with the highest levels of leadership at law firms.

“We use our expertise and long-standing relationships with senior management in the legal field to provide our clients with the granular and often overlooked details regarding the law firm, culture, position, and search process,” Michelle says. “Tapping into our expertise allows attorneys to make the best decision for their careers moving forward.”

The Foster Group highlights three key trends shaping the legal hiring market

While a number of developments are influencing the lateral market, The Foster Group sees three trends in particular as having a significant impact on both law firms and attorneys. The continued emphasis on strategic partner hiring is one of the most notable.

Rather than building practices slowly over time, many firms are accelerating growth by recruiting experienced partners who can immediately expand their capabilities and client reach. For partners evaluating potential moves, the current environment presents meaningful opportunities but also requires careful evaluation.

“The most successful partner transitions occur when there is true strategic alignment between the lawyers’ practice and the firm’s long-term vision,” says Drew. “Compensation matters, but platform, collaboration, cross-selling opportunities, and the firm’s growth strategy are often even more important for long-term success.”

The growing prominence of the counsel role and non-equity partner role is another important shift in the legal market. Historically viewed as transitional positions between associate and Equity Partner, counsel and non-equity Partner roles are increasingly becoming established career paths within many firms. Many firms have begun to view the positions as a way to retain highly skilled attorneys who bring deep technical expertise or institutional knowledge.

According to SurePoint Technologies’ 2025 State of the Legal Industry Report, “Lateral hiring hit a historic high, rising nearly 9% across both the Am Law 200 and firms outside it,” for a total of more than 28,000 lateral hires in 2025. The report goes on to state that “Firms beyond the Am Law 200 set a record with 15,199 laterals hires,” and that “Counsel hiring surged 18% in the Am Law 200, making it the fastest-growing role as firms expand non-equity leadership tracks.” By comparison, hiring associates increased by 11.7% over the year prior, and hiring for partners increased by 10.6% per SurePoint’s report.

“For lawyers, this evolution has created additional flexibility in how they structure their careers,” Drew explains. “Counsel roles can provide opportunities to work on sophisticated matters while offering a different balance of responsibilities.”

Perhaps the most encouraging trend for the legal market overall is the continued investment by law firms in legal talent. Firms across the board remain focused on strengthening their teams and positioning themselves for long-term growth even amid fluctuations in certain practice areas. Strategic hiring continues across key sectors such as private equity, M&A, finance, litigation, energy, and real estate.

“The demand for exceptional lawyers has remained remarkably resilient,” Michelle says. “Firms understand that their ability to serve clients and compete at the highest level depends on attracting and retaining outstanding talent. For attorneys with productive practices or specialized experience, this environment presents meaningful opportunities.”
